The NSW government has released a draft package of land management and biodiversity conservation reforms. This includes a Biodiversity Conservation Act 2016 – assented to on 23 November 2016 – (and related: the Local Land Services Amendment Act 2016) but not yet commenced. The proposed start date for commencement is 25 August 2017 – but it relies on Regulations and subordinate instruments that are on exhibition until June 2017. Be prepared for changes to begin in accordance with the new Act, Regulations and subordinate instruments in late August!

The proposed legislation will:

  • change the threatened species impact assessment processes;
  • make offsets mandatory for certain impacts; and
  • provide new options for delivering offsets.

The changes will affect proponents of development, land managers as well as the regulators.
