Our Partner, Kamal Shankar, along with Senior Associates Tanmay Sharma and Arjun Narang, and Associate, Shivam Jain, successfully represented Bharti Telecom Limited before the Supreme Court of India.

In its judgment, the Court has authoritatively settled the legal position that obtaining a valuation report is not a mandatory requirement for implementing a scheme of capital reduction under Section 66 of the Companies Act, 2013. The decision further reiterates that valuation is a specialised exercise best left to experts, reinforcing established principles governing corporate restructuring.

This ruling provides important clarity on the framework for capital reduction and the role of valuation in such processes.
