CMS Luxembourg has assisted Avellinia Capital (AvCap), a private credit investment firm that provides asset-based financing and capital solutions to startups and scale-ups in the innovation economy, supporting growing businesses with flexible, tailor-made financing (learn more at www.avellinia.com), in the establishment of a EUR 1b Limited Recourse Note Programme.

Our capital markets team provided comprehensive legal support throughout the structuring and implementation of the Limited Recourse Note Programme, including the preparation of final terms and transaction documentation to enable the issuance of the first notes under the Limited Recourse Note Programme. The first notes were subscribed by British Business Bank.

Our team has worked closely with Avellinia Capital (AvCap) on all legal aspects of the transaction documentation.

CMS acted as lead counsel, with the capital markets team made up of José Ocaña (Counsel), and Stamatina Stylianopoulou (Associate).
