ESDC has set out new data that employers using the Temporary Foreign Worker Program need to be aware of when making LMIA applications.
Based on 2014 data, the new wage information will be utilized starting on April 30, 2015. The prior wage information was based on 2013 data.
The list of provincial median hourly wages has been updated. This is the figure that dictates whether an LMIA application is considered to be a "high-wage" or "low-wage" position. A high-wage position application will usually require a Transition Plan as part of the LMIA application. A "low-wage" position application does not require a Transition Plan, but will usually be subject to a cap on the number of low-wage positions that may be filled by foreign nationals.
The figures for the top 10% wage earners for each province have also been revised. If the wage being offered for a position is at or above the top 10% for the province where the position will be located, the LMIA application is supposed to be eligible for 10 day speed of service from ESDC.
Employers using the LMIA process should always take steps to ensure that they are utilizing the most up to date application forms and data when applying for an LMIA, and it is therefore recommended that employers refer to the ESDC website each time they make and LMIA application.
