Mit seinem Engadin-IV-Entscheid hat das Bundesverwaltungsgericht
das empfindliche Gleichgewicht zwischen Kooperationsobliegenheiten
und Verteidigungsrechten einer Selbstanzeigerin verschoben und
damit die Prognostizierbarkeit des Verfahrensausgangs erschwert. In
Bezug auf die Zulässigkeit der risikofreien Ausübung von
Verteidigungsrechten bedarf es dringend einer Klarstellung
vonseiten der Behörden und Gerichte. Ansonsten droht das
Institut der Selbstanzeige bedeutungslos zu werden.
