On 26 March 2020, we published an article titled 'COVID-19: Mergers and Acquisitions must continue to be notified to the Office for Competition where the notification obligation under the Control of Concentrations Regulations applies', which can be accessed from here.
This note is intended to update our article by taking into account the information published subsequently by the Office for Competition (OC) on 27 March 2020. This information explains how notification forms of notifiable mergers and acquisitions (referred to as 'concentrations' in the Regulations) should be submitted to the OC during the COVID-19 outbreak.
The OC announced that the notification form together with all supporting documents must be submitted to it in electronic format via email. The information published by the OC can be found here. This link provides:
- the email address on which the notification form should be sent;
- a telephone number for any queries; and
- the bank details for the payment of the notification fee.
The OC has also clarified that the delivery of the original notification form will only be required where the OC specifically requests it.
