How is it determined whether a dispute is arbitrable in your jurisdiction?

Answer ... In accordance with the Arbitration Act, a dispute may be resolved by arbitration if:

  • it concerns matters of which the parties can freely dispose (Article 1(2)); and
  • its resolution is not under the exclusive jurisdiction of a Macedonian court (Article 1(6)).

Are there any restrictions on the choice of seat of arbitration for certain disputes?

Answer ... Pursuant to the Arbitration Act, an arbitration may be seated outside Macedonia only if at least one of the parties, at the time of conclusion of the arbitration agreement, is:

  • a natural person with his or her domicile or habitual residence abroad; or
  • a legal person whose place of business is abroad (Article 1(5)).
