Worldwide: Arbitration in Ghana: Keeping Up with Key International Best Practices & Developments

Arbitration has gained traction in Ghana. The enactment of the Alternative Dispute Resolution Act, 2010 (Act 798) over a decade ago marked a watershed in the practice of Arbitration in Ghana. The Act to a large extent was fashioned around the UNCITRAL Model Law and included key provisions promoting party autonomy, separability and the finality of arbitral awards. 

Arbitration continues to evolve significantly after the passage of Act 798. In recent times, issues of third-party funding, multiple parties in arbitration, emergency arbitrators, extension of arbitration agreements to non-signatory parties have taken the centre stage in various discussion about international arbitration. The evolution of international arbitration has seen some countries undergoing legislative reforms to ensure that their arbitration laws are in tune with modern best practices. 

This webinar seeks to trace the major and recent developments on arbitration in Ghana since the passage of Act 798. It shall highlight the significant progress in arbitration practice in Ghana and also consider key areas which calls for improvement to bring arbitration practice in Ghana up to speed with international developments.

SPEAKERS
Nene Amegatcher

Nene Amegatcher is a Senior Partner at Sam Okudzeto & Associates and a retired Justice of the Supreme Court of Ghana. He has over three decades' experience in private legal practice and academia. He is an expert in Civil Litigation, Corporate and Commercial Law, and Alternative Dispute Resolution. 

Nene has served as a resource person in training judges, lawyers, and other key stakeholders in ADR in Ghana, Nigeria, Senegal and The Gambia. He is a former President of the Ghana Bar Association and has served as the Ghana Representative of the ICC Court of Arbitration. He holds an LLM in Advanced Litigation and Dispute Resolution from Nottingham Trent University in the United Kingdom.

Melisa Amarteifio

Melisa Amarteifio is a Partner at Sam Okudzeto & Associates. Her areas of focus are civil litigation, property law, tax law, commercial law, Alternative Dispute Resolution and Intellectual Property.

Melisa has significant experience in arbitration and has acted as counsel representing a rubber production company in a multi-million-euro arbitration where she successfully secured an arbitral award in favour of her client.

She was until 2016 the Ghana Bar Association’s Representative on the Rules of Court Committee where she helped in the amendment of civil procedure rules for lower and Superior Courts of Ghana.

Isaac Aburam Lartey

Isaac is a Senior Associate at Sam Okudzeto & Associates where he focuses on litigation and dispute resolution. 

He has experience in property, employment and commercial disputes particularly in the manufacturing, real estate and construction sectors. Isaac has acted as counsel for clients in commercial disputes at the Ghana Arbitration Centre. 

He holds an LLM in Comparative and International Dispute Resolution from the School of International Arbitration, Queen Mary University of London. He is also a Guest Lecturer at the University of Ghana School of Law where he teaches International Commercial Arbitration and Investment Treaty Arbitration.
