Worldwide: Are You Ready For India’s New Advertising Laws?

In this webinar an expert panel will discuss recent changes in India’s advertising laws and regulation under the Consumer Protection Act and voluntary code administered by the Advertising Standards Council of India including:

  • False & Misleading Advertising Guidelines;
  • Specific Sector Guidelines for Influencers, Virtual Digital Assets and Gaming:
  • Comparative Advertising;
  • Surrogate Advertising for alcohol and tobacco products;
  • Practical implications of recent changes and potential responses.

This event is especially curated for foreign corporations and law firms will be of particular interest to in-house counsel and other corporate executives concerned with advertising and marketing of goods and services in India.

SPEAKERS
Rishi Gautam

Rishi Gautam is Global General Counsel for Tata Consumer Products and a member of its Executive Committee. Tata Consumer is a member of the Tata Group and is one of the leading FMCG companies in India. Rishi is an experienced Indian corporate lawyer, with significant international experience having worked in two leading global firms in London and in Sydney and been a partner in two of India’s leading commercial law firms where he specialized in Mergers and Acquisitions, Private Equity, Joint Ventures, Corporate Advisory.

Subhash Kamath

Subhash is an advertising industry leader in India. He has worked with global creative agencies including Ogilvy, Trikaya Grey, and Publicis Ambience. Subash recently retired as chief executive at advertising agency BBH & Publicis Worldwide, India. He led BBH India for more than 10 years with a portfolio of clients including Unilever, Marico, Johnnie Walker, Google, Uber, Skoda, and Red Bull. He has been Chairman of the Advertising Standards Council of India since 2020.

Manisha Kapoor

Manisha is Chief Executive of The Advertising Standards Council of India which administers self- regulation of the advertising industry in India. She has had more than 25 years in building brands working with companies like Hindustan Unilever and Johnson& Johnson including 15 years consulting on brand development and strategy.

Tanu Banerjee

Tanu Banerjee is a Partner in the Corporate and Commercial practice group of Khaitan & Co. She focusses on technology, media, entertainment, corporate and commercial law and regularly advises clients on media related matters including advertising and marketing compliance, regulatory, and advisory. She has been recognised as a recommended TMT lawyer by Legal 500 – Asia Pacific and included in Asian Legal Business India Super 50 lawyers 2022.

Nishad Nadkarni

Nishad is a Partner in the Intellectual Property practice group of Khaitan & Co. specializing in intellectual property law as well as related litigation and arbitration. Nishad has more than 2 decades experience in contentious and non-contentious intellectual property matters especially related to media and entertainment. He regularly advises corporations on ASCI complaints and comparative advertising and . Nishad and three of his partners as a team were recognized by Asian Legal Business as India’s Top Intellectual Property Lawyers in 2021.

Sameer Sah

Sameer is a partner in the corporate and commercial practice group at Khaitan & Co and is an expert M&A lawyer specialising in strategic M&A, joint ventures, collaborations, foreign investments, private equity, and regulatory approvals for India investment. He has extensive experience in cross border transactions and advises clients on regulatory and other issues pertaining to the pharmaceutical, healthcare, manufacturing, retail, and franchising sectors.
