United States: Current Issues in the Mediation of Bankruptcy Disputes

Bankruptcy disputes in any chapter of the Bankruptcy Code can present special challenges for settlement, especially where a diverse set of parties in interest—debtors, un/secured creditors, creditors' committees, officers and directors, insurance companies, indeed all parties affected by a bankruptcy—have competing claims and interests.  Complex and intersecting disputes can be further complicated by the presence of pro se parties and parties and counsel unfamiliar with the intricacies of bankruptcy law and procedure.  Alternative dispute resolution techniques may allow parties and counsel to effectively dispose of disputes in contested matters, adversary proceedings and even pre-demands.

This webinar will discuss current work in the evaluation and settlement of these matters, as well as proceedings in non-dischargeability, discharge/stay violations, chapter 11 plan confirmations, and director’s and officer’s liability matters.  Panelists will also discuss recent experience handling these matters in the virtual environment, as well as practice trends in the COVID era. SPEAKERS
Charles Clevert

Hon. Charles N. Clevert, Jr. (Ret.) joined JAMS after nearly 40 years of distinguished service on the federal bench. Judge Clevert presided over a wide variety of complex litigation matters, including civil rights and discrimination cases, contract disputes, ERISA litigation, torts, product liability, chapter 11 business reorganizations and many others. Appointed at age 30, Judge Clevert became the youngest federal bankruptcy judge in the nation and Wisconsin’s first African American federal judge. He went on to serve for over 20 years on the U.S. District Court for the Eastern District of Wisconsin, including three years as Chief Judge of that court.

Joan Feeney

Hon. Joan N. Feeney (Ret.) joined JAMS following almost 27 years on the bench of the United States Bankruptcy Court for the District of Massachusetts and 23 years as a member of the United States Bankruptcy Appellate Panel for the First Circuit. Judge Feeney presided over a full range of cases, including complex commercial cases with multiple parties and conflicting interests. While on the bench, she wrote over 500 opinions in many different areas of the law. Judge Feeney has an incomparable ability to distill even the most complex case down to its essence, while still minding the details.

Phillip Shefferly

Phillip J. Shefferly joined JAMS in Detroit following 18 years of distinguished service to the U.S. Bankruptcy Court for the Eastern District of Michigan, including over a decade as chief judge. As a judge on one of the heaviest bankruptcy court dockets in the country, Judge Shefferly conducted hundreds of bench trials and motion hearings that required prompt and thorough decisions. He presided over many large chapter 11 cases in a wide range of industries, including automotive, manufacturing, real property, retail, professional services, hospitality, nursing home and health care.  Before taking the bench, Judge Shefferly was in private practice for 24 years.
