Seeking early publication of a patent application? If so, a request for an early publication must be accompanied by the publication fee set forth in 37 CFR 1.18(d). Applicant must also submit a copy of the application in compliance with the Electronic Filing System (EFS) requirements in 37 CFR 1.215(c) or the USPTO will publish the application as provided in 37 CFR 1.215(a). Instances where the EFS requirements are not met, the application will be published as originally filed. The USPTO will not give consideration to requests for publications on certain dates. Such requests will be treated as a request for publication as soon as possible.
