In January, the Centers for Medicare and Medicaid Services (CMS) published very helpful guidance on the implementation of the waiver of the Skilled Nursing Facility (SNF) 3-Day Rule for certain Medicare Shared Savings Program (MSSP) ACOs.  The SNF 3-Day Rule Waiver waives the requirement for a 3-day inpatient hospital stay in order to get Medicare coverage for a post-hospital admission to a SNF for eligible beneficiaries. The guidance explains the genesis of the SNF 3-Day Rule Waiver, waiver eligibility criteria for MSSP ACOs and SNF affiliates, the need for a beneficiary communication plan, directions on how to apply for the waiver, and a sample agreement for SNF affiliates.
