Please join us at our Employment Law Update session, at which we will guide you through some of the changes anticipated this year.

The session will be split into three parts:

Flexible Working

The right to request flexible working will be extended to all employees from 30 June 2014.

The draft ACAS statutory code of practice and associated "good practice" guide leave many questions (the tricky ones!) unanswered. We will use a scenario to help stimulate discussion regarding how you would tackle issues like these in practice.

Holiday Hotspots

The latest European case law on working time holidays and holiday pay potentially exposes employers to claims for back-pay, possibly going back many years. John Lewis recently paid out £40 million to employees as a result of the miscalculation of holiday pay. Many employers are not yet aware of the significance of these developments. We will run through the principles that the recent cases have established and give you a taste of what strategies you could use to limit your exposure to such claims.

Employment Tribunal Barriers

Two further measures designed at reducing the number of disputes that reach Employment Tribunal will come into force this year:

  • Mandatory pre-claim ACAS conciliation.
  • The power of the Employment Tribunal to impose penalties on losing employers in certain circumstances.

We will take you through the detail of these new measures (some of it is not as it first seems) and then we will have some discussion regarding the impact we/you think these measures will have.
