Standard trust deeds offered to clients by trust committee frequently contain wide exoneration clauses. The Royal Courts of Jersey have recently examined the validity of these clauses and this article examines these developments.
From this case it is clear that Jersey courts will uphold the legitimate interests of settlors and beneficiaries.
