保護主義立法により、ロシア国内の子会社や支店からの情報取得が困難になるおそれ
ロシア下院は情報保護に関する連邦法の改正を提案しており、同改正案が成立した場合には、ロシア国内の個人や会社から外国の法執行機関に対する情報提供が制限されます。また、法案の文言が抽象的であることから、ロシア国内に子会社や支店を有する外国企業が、同子会社等から情報の提供を受けるためには、ロシア政府機関の承認が必要となるおそれがあります。
このため、同法案が成立した場合には、ロシア国内の個人や法人に対するデュー・デリジェンスや訴訟、仲裁時の情報開示請求等が事実上不可能となる可能性もあり、日本企業にも重大な影響を与える可能性があるため、ご紹介いたします。
