In the recent Licence Appeal Tribunal (LAT) decision in Burton v. Co-operators General Insurance Co., our team, led by Kaitlyn MacDonell, achieved a rare and impactful outcome for an injured Ontarian whose claim had been wrongly denied due to a technicality. In a case where the insurer refused to reverse its decision despite clear evidence of severe injury and care needs, the LAT not only ruled in our client's favour but also found the insurer's conduct to be egregious, awarding enhanced accident benefits of up to $3 million over his lifetime.
