Represented Pulak Modi In the suit for recovery filed under the Commercial Courts Act of 2015. The plea of our client was to seek attachment of the bank account of the defendant under Order 39 Rule 1 and 2 of the Code of Civil Procedure 1908. The Hon'ble Court was pleased to grant leave under Section 12A Of the Commercial Courts Act, 2015 and invoked it's inherent powers under Section 151 of the Code of Civil Procedure, 1908 and restrained the defendant from operating its bank account. The Hon'ble Court did not find any reasons to revoke leave granted under Section 12A of the Commercial Courts Act, 2015. It is to be noted that orders of attachment have been passed in exercise of powers under section 151 of Code of Civil Procedure, 1908 and not under the provisions of Order 38 Rule 5 of Code of Civil Procedure, 1908.
