Pravin Anand was invited to a symposium on 'Power of Mediation in Business World' organized by the Association for India International Mediation & Arbitration Services (AIIMAS).
Delving into the 'Use of Mediation in IP Cases', Mr Anand spoke about the success of IP mediation post 2005. He also cited the 'Samadhan Report' from the Delhi High Court's Mediation and Conciliation Centre according to which, between 2020 – 2023, 1012 commercial disputes out of 3642 were settled through Mediation. IP mediation has a success rate of 80-85 percent. World Intellectual Property Organization – WIPO Arbitration and Mediation Centre has settled around 2800 IP Disputes between 2014 to 2023. Of all the IP disputes resolved by WIPO Arbitration and Mediation Centre, 70 percent were resolved by Mediation.
In his presentation, Mr Anand also referred to Gavin Kennedy's 'The New Negotiation edge' wherein he talks about 'Purple' style of negotiation (not as aggressive as 'red', neither passive as 'blue' but utilizing the benefits while tempering the weaknesses of both). This, he said, to emphasise the need for civilized dispute settlement mechanisms.
