The implementation of the new Building Act 2011 has been delayed.

The new Building Act 2011 was intended to commence in October 2011 but has been delayed to 1 January 2012.

Although regulations have not yet been released, the drafting instructions (a final version of which will be used by Parliamentary Counsel to draft the regulations) have been released successively for comment and can be obtained from www.buildingcommission.wa.gov.au.

The regulations will cover some very important items such as;

  • the number of days a local government can take to determine an application;
  • what the official forms will look like which must be used to make an application; and
  • what fees for applications will apply.

We expect that the regulations will be released prior to mid December 2011. If so, we will update you then.

The content of this article is intended to provide a general guide to the subject matter. Specialist advice should be sought about your specific circumstances.
