Insolvency litigation poses challenges for companies and creditors, necessitating effective strategies to maximize recoveries. This webinar offers practical guidance on navigating insolvency litigation, focusing on claims against directors and officers.

The speakers will explore fundamental concepts and implications for creditors. Emphasis will be placed on pursuing claims against directors and officers for optimal recovery outcomes. Practical guidance will be provided for identifying potential claims and gathering essential evidence. Strategies for establishing breaches of fiduciary duties and other claims will be covered.

Participants will learn how to build strong cases supported by compelling evidence and expert opinions. The role of Directors and Officers (D&O) insurance in maximizing recoveries will be examined, including coverage, limits, and effective strategies for leveraging this insurance. Collaboration among legal professionals, insolvency practitioners, and forensic experts will be highlighted.

Real-world examples of successful partnerships will be shared. Participants will gain insights into valuing assets, identifying potential claims, and formulating effective litigation strategies. Pursuit of third-party claims and assessment of settlement opportunities will be addressed, including claims against auditors, advisors, and business partners. SPEAKERS
Anthony Idigbe

Dr. Anthony Ikemefuna Idigbe is the Senior Partner at PUNUKA Attorneys & Solicitors. He is also involved with consultancy, business and human capital development through its Canadian affiliate, PUNUKA Consulting Inc.

He has over 39 years of experience in corporate governance, insolvency, business restructuring, arbitration, dispute resolution, privatization, capital markets, mergers & acquisitions, and oil and gas. He has advised clients on several complex transactions.

He was licensed to practice law in Nigeria in 1983 and Ontario, Canada, in June 2016, appointed Notary Public in 1989 and elevated to Senior Advocate of Nigeria (SAN) in July 2000. He holds a doctorate in cross-border insolvency from Osgoode Hall Law School, York University, Toronto, Ontario, Canada. His dissertation was on Norm Life Cycle Theory and the role of INSOL International in shaping the 1997 UNCITRAL Model Law on Cross-Border Insolvency.

Okorie Kalu

Okorie is a Partner at the Firm and currently heads the Insolvency and Training/Special Projects Practice Groups. He graduated from the Universite du Benin (now Universite de Lome) where he obtained his Bachelor’s degree in Law as well as Masters degree in Commercial Law.

He also attended the University of Lagos and was called to the Nigerian Bar in 2004. Okorie is fluent in both French and English. He is a member of the Nigerian Bar Association, Second Deputy President MBA SBL Committee on Banking, Finance and Insolvency; General Secretary and Fellow of the Business Recovery and Insolvency Practitioners Association of Nigeria (BRIPAN). He is also a member and fellow, INSOL International.

Ibrahim Buba

Justice Ibrahim Buba was appointed as a federal judge in November 2003 and subsequently sworn in as a judge of the Federal High Court in January 2004.

Throughout his illustrious career, he has served in various divisions of the Federal High Court, including Katsina, Port Harcourt, Jos, Lafia, Asaba, Lagos, Enugu, and Bauchi. Justice Buba has garnered acclaim for delivering landmark decisions across a wide range of legal domains, such as commercial law, admiralty law, constitutional law, criminal law, terrorism, and insolvency matters.

He has actively participated in training programs and conferences within Nigeria and abroad, representing Nigeria in the prestigious Special International Forum of Commercial Courts (SIFOOC).

In addition to his judicial responsibilities, Justice Buba is recognized for his profound knowledge of Nigeria, encompassing its languages, cultures, and ways of life. Described as a devoted family man, a farmer, and an avid enthusiast of reading, music, and sports, he embodies a diverse set of interests. Justice Buba reached the mandatory retirement age of 65 in 2023, and his affable demeanor and harmonious relationships with court staff and fellow judges have earned him immense respect.
