Worldwide: Funding or insurance? Commercial Approaches for Litigation and Arbitration

Whilst the global litigation funding market has become familiar in recent years, the value of insurance as an alternative or adjunct to finance is less well-known.

In this webinar, affiliates Erso Capital and TheJudge weigh up the finance and insurance options available to corporates and their lawyers involved in litigation or arbitration.

The discussion will cover:

  • Case studies where insurance and funding have been deployed in novel ways and comparing financial outcomes;
  • Considering where the funding and insurance markets are heading in this space; and
  • The use of insurance as an alternative to funding and why it should be considered

Chaired by Sarah Breckenridge, we will be joined by James Blick and Caroline Parker-Beaudrias of Erso Capital, and Robert Warner of TheJudge.

SPEAKERS
James Blick

James co-founded Erso Capital in 2020 and is based in the Southern California office. James sits on the Erso board and investment committee. A regular speaker on the topics of litigation finance and litigation insurance and an acknowledged expert in the field,in 2020  he was recognised by LawDragon as one of the top 10 advisors to the global legal finance industry. 

Robert Warner

Robert is head of broking operations at TheJudge. Robert began his career in After the Event insurance in 2006, working for both brokers and insurers before joining the commercial litigation underwriting team of a leading ATE insurer in 2011 and eventually spending the last few years as the underwriting manager at that insurer before joining TheJudge. Robert specialises in arranging complex multi-layered litigation funding and ATE insurance solutions, as well as arranging the monetisation of insolvency litigation as well as domestic and international court judgements and arbitration awards. 

Sarah Breckenridge

Sarah is an English qualified solicitor-advocate. She has a unique combination of practice at a senior level as a corporate/commercial litigator, and as a director-level disputes knowledge lawyer. Prior to joining Erso a significant part of her knowledge management role at global firm Bryan Cave Leighton Paisner involved forging the firm's policy and practice with regards to litigation funding, insurance and alternative fee arrangements. She has a wealth of experience in the way lawyers approach funding and costs with their clients, and an understanding of the impact of funding on the process and outcomes of disputes.

Caroline Parker-Beaudrias

Caroline is Investment Counsel at Erso Capital. She handles all aspects of the underwriting process, from due diligence of new investment opportunities through to deal execution and ongoing investment monitoring. Prior to joining Erso, Caroline was a litigator at Hughes Hubbard & Reed LLP, widely regarded as having a leading disputes practice in North America. She has represented both foreign and domestic clients in all phases of complex business litigation. Her extensive experience was primarily on the defense side, including frequent engagements for Fortune 500 and Global 500 companies.
