Canada: Future Series: The Future of Employment Law in Canada - Current Trends and Predictions

The last year has been unlike any other, with the COVID-19 Pandemic affecting everyone and everything the world over.  Aside from impacts to individual people's health, one of the most significant ways the Pandemic has affected life is in the way it has forced businesses to adapt and adjust to new and changing realities just to survive, let alone thrive, in the present environment.  Nowhere is that more true than in looking at the myriad changes forced on businesses big and small with respect to dealing with their employees.  From COVID screening to Remote working arrangements, legislative changes to aggressive litigants, employers have been forced to re-evaluate their systems, protocols and processes "on the fly" as the landscape shifted around them.  Some of these changes are by their very nature time-limited, or event-specific responses to particular aspects - legislative or otherwise - of the Pandemic, while others may be here to stay even when the Pandemic has receded.  Join us on May 11th as we review and explore current trends and predictions for the future in Canadian employment law, including:

- Employment law implications of the shift toward the gig economy;
- Rights and obligations of employers managing a remote workforce;

SPEAKERS
Kelsey Orth

Having completed a Master’s Degree in Industrial Relations in addition to his law degree, Kelsey strives to understand his clients’ “big picture”, allowing him to provide strategic and proactive advice. In this way Kelsey assists employers from all sectors, both federally and provincially, in avoiding exposure and limiting risk.  In particular, Kelsey focuses on dealing with unionized labour disputes, collective agreement negotiations and working through the grievance and arbitration process.  Kelsey is also a proficient and persuasive advocate for employers at all stages of the litigation process, whether before an administrative tribunal, in grievance arbitration, or in civil litigation.

Arjun Dhir

Arjun’s practice centres around advising public and private sector clients, including unionized and non-unionized employers, on labour, employment and human rights matters. Arjun’s perspective is unique having gained extensive experience advising both employers and employees on a broad spectrum of employment matters throughout his career. Arjun’s main focus is mitigating risk for employers by providing strategic, client-specific advice on issues that may arise during the course of the employment relationship. However, in the event of an escalation, Arjun also represents employers in disputes stemming from claims related to wrongful dismissal, employment standards, human rights discrimination and grievance arbitrations. 

Susan Crawford

Susan is an accomplished and influential advocate. Susan represents employers in wrongful dismissal actions, litigation to enforce employee fiduciary, non-solicitation and non-competition obligations, labour injunctions, judicial review applications, Occupational Health and Safety Act prosecutions, EI and CPP independent contractor status appeals before the Federal Court, human rights, employment standards and pay equity proceedings. Susan has appeared before various provincial and federal labour tribunals and all levels of court on behalf of employers. In addition, Susan assists employers in workplace investigations and conflict resolution, as well as providing training on a variety of workplace issues.
