On January 19, 2021, the ITC issued a Notice of Investigation in Certain UMTS and LTE Cellular Communication Modules and Products Containing the Same (Inv. No. 337-TA-1240).

By way of background, this investigation is based on a December 17, 2020 complaint filed by Koninklijke Philips N.V. of the Netherlands and Philips RS North America LLC (f/k/a Respironics, Inc.) of Pittsburgh, Pennsylvania (collectively, "Philips") alleging a violation of Section 337 by ten respondents in the unlawful importation and sale in the U.S. of certain UMTS and LTE cellular communication modules and products containing the same that infringe Philips' U.S. Patent Nos. 7,831,271; 8,199,711; 7,554,943; and 7,944,935. According to the complaint, the asserted patents generally relate to improved methods and devices to enable flexible and efficient multiplexing of data packets, and solve various problems in radio and mobile communications systems. Philips is requesting that the Commission issue a permanent general and limited exclusion order and a permanent cease and desist order directed to respondents. According to the Notice of Investigation, the Office of Unfair Import Investigations will participate as a party in the investigation. Lastly, Chief ALJ Charles E. Bullock issued a notice indicating that ALJ David P. Shaw will preside in the investigation.
