Lisa Phelan spoke to Global Competition Review about the U.S. Department of Justice's (DOJ) trial in Colorado against 10 former and current chicken company executives and employees that it accuses of fixing broiler-chicken prices.

Late last week, the DOJ asked the judge to dismiss a former Pilgrim's Pride sales director's false statement and obstruction charges with prejudice. According to Lisa, it is very rare for the DOJ's antitrust division to move to dismiss charges following an indictment, and even so during trial.

Lisa said that the department may move to dismiss because a witness or fact may no longer support the charges. The agency could also no longer be confident that it can obtain a conviction for such charges, she added.
