Companies increasingly rely on automated decision-making tools (ADMTs) for employee and recruiting, underwriting, and other business decisions, a trend expected to continue amid federal AI regulatory rollbacks. On 19 May, NERA Managing Directors Ling Ling Ang and Elizabeth Newlon and Duane Morris LLP Partner Gerald Maatman, Jr. and Special Counsel Justin Donoho will explore the risk of litigation over alleged discriminatory bias in the decisions supported by ADMTs.
This complimentary CLE webinar will explore key topics including litigation trends involving AI technologies, state-by-state legislative updates, government enforcement agendas, and best practices and risk mitigation. The session will also provide an in-depth review of Dr. Ang and Dr. Newlon's article "Automated Decision-Making Tools and the Potential for Discriminatory Bias: Labor and Employment, Fair Lending, and Beyond," which aims to clarify the uncertainties surrounding how discrimination claims based on ADMT bias will be demonstrated or refuted in court using statistical evidence. The speakers will further expand on discussing algorithmic bias, limited US litigation and guidance related to bias in ADMTs, and approaches to auditing for algorithmic bias to mitigate the risk of litigation.
