The Board reviewed the Passolig system, the football ticketing system in Turkey. It granted Passolig individual exemption until the end of the 2016-2017 football season.

The Board reviewed the Passolig system, the football ticketing system in Turkey. It granted Passolig individual exemption until the end of the 2016-2017 football season.

Passolig is the new system of electronic cards for the sales of football tickets. This system is established through some underlying agreements between the Turkish Football Federation (“TFF”), Aktif Bank and E-Kent Teknoloji ve Ödeme Sistemleri–Netaş Telekomünikasyon Consortium (“E-Kent–Netaş Consortium”).

The Board's decision relates to a preliminary investigation initiated against Aktif Bank and TFF on the allegations that (i) the tenders organized by TFF were not open and transparent and therefore anticompetitive, and (ii) Aktif Bank abused its dominance through tying and discrimination.

The Board concluded as follows:

  1. The underlying agreements fall under Article 4 of the Law No. 4054 on the Protection of Competition (“Competition Law”), which is akin to Article 101 of the TFEU,
  2. These agreements can benefit from individual exemption for a certain period of time,
  3. The case will be re-evaluated at the end of the 2016-2017 football season, and
  4. There is no need to initiate a full-fledged investigation against Aktif Bank for an alleged abuse of dominance.
