Our upcoming panel, Hot Topics in White Collar Crime and Regulatory Compliance, will look at key trends and developing areas of white collar crime enforcement and how in-house counsel should approach these topics from a compliance standpoint. We will particularly focus on the areas of cybersecurity, cryptocurrency, and strategies for responding to and navigating government investigations and inquiries.
For years, employers have been exploring the possibility of how automated tools (ranging from basic computer screening methods to advanced AI systems) may be able to improve and simplify the hiring process and other employment-related evaluation processes. And now, with NYC Local Law 144 going into effect in 2023, the new frontier of algorithmic decision-making in the workplace – and regulation of the same – is upon us.
NYC Local Law 144 is the most robust law regulating “automated employment decision tools” (AEDTs) to date, and it prohibits employers from using AI in employment decision-making processes unless they take a number of affirmative steps prior to doing so, including a bias audit of the tool. A key aspect of this bias audit is that it can also serve to enhance an employer’s attainment of its diversity, equity, and inclusion goals by ensuring that the use of AEDTs does not foster unintended bias or create unintended workforce disparities.
Mintz Member Nathan Coco will speak on a panel titled "Intensive Care for Distressed Hospitals: Sales, Auctions & Affiliations" on Thursday February 9, as part of the NFMA conference. Panelists will focus on strategic alternatives for distressed acute care hospital credits. They will examine case studies which highlight strategies bondholders may have to maximize returns in these scenarios.
The panel, "Are Representations and Warranties Claims Increasing in Severity? An Update on Claim Trends", will occur from 2:30 pm to 3:35 pm (EST). This esteemed panel, featuring Nancy Adams, will begin its conversation with an update of current R&W claim metrics - focusing on frequency, severity, allegation types, etc. The group will then review current trends and what has changed in the last year. Finally, the panelists will provide their unique insights into future claim opportunities and challenges facing insurers, brokers and clients.
This session will present a background primer on the concepts of blockchain and cryptocurrency and then apply that background to a discussion of the various tax and securities law concepts that apply to the utilization of cryptocurrency as a compensation tool.
The panelists, featuring Michelle Capezza and Anne Bruno, will discuss issues raised by using cryptocurrency in lieu of cash to compensate employees and other service providers and will also address the ways that cryptocurrency can form the basis of various forms of incentive compensation. The latest guidance regarding investing qualified retirement plan assets in cryptocurrency will also be presented.
