On November 5, Associate Erica Turret represented the National Health Law Program (NHeLP) in oral argument before the DC Circuit, challenging Indiana's restrictions on Medicaid coverage.
The appeal is part of a series of cases Jenner has worked with NHeLP to protect the rights of Medicaid beneficiaries and ensure access to coverage. This case involves Indiana's effort to restrict access to Medicaid benefits.
Erica was part of a team representing NHeLP in the district court, where they secured a favorable decision from Judge Boasberg. While the federal government declined to appeal, Indiana did appeal, creating complex procedural questions.
The appeal presented two key issues. On jurisdiction, Erica and the federal government argued against the DC Circuit's jurisdiction to hear the case. On the merits, Erica was positioned against both Indiana and the federal government, advocating for Medicaid beneficiaries' access to coverage.
In addition to Erica, the team included Partner Ian Gershengorn.
