John Dyrud, Partner, and Harry Wiggin and Gerhard H.A. Wallbank, lawyers at Anguilla law firm Webster Dyrud Mitchell, are currently actively participating in the development of the Anguilla Private Foundations Act, which will broaden the appeal of Anguilla for a whole new category of financial services clients. This is expected to be enacted in the near future.
The Act will enable Anguilla to offer the civil law private foundation concept as an alternative to the existing common law trust available in Anguilla, while providing a high level of protection in terms of anti-forced heirship rules and rules overriding foreign laws and judgments.
These strong protections will keep Anguilla at the forefront in this field. John Dyrud says: "We consider that the proposed Anguilla legislation is an improvement over previous foundations legislation enacted in other jurisdictions and that it will be warmly welcomed in the international estate planning community.
