Thelen Reid has successfully concluded a long-running arbitration at the International Chamber of Commerce (ICC) Court of Arbitration on behalf of Colliers International Property Consultants (Colliers), an association of real estate firms throughout the world.
The case involved intellectual property infringement by a Malaysian entity and former association member, Colliers Jordan Lee & Jaafar Sdn. Bhd. (CJLJ). Even after Colliers terminated CLCJ’s membership for failing to live up to association standards, CJLJ had stubbornly continued to use the Colliers name.
New York-based litigation partner Eli Mattioli and senior associate Hermann Ferré, working in coordination with San Francisco-based intellectual property licensing partner and client manager Rauer Meyer, initiated arbitration with the ICC court in London in August 2003.
Due to the diligent efforts of Thelen Reid’s ICC arbitration team, Colliers has now won everything they sought, including an injunction preventing CJLJ from using the Colliers name, an accounting of how CJLJ profited from the improper use of its name, and full recovery of legal costs for the arbitration.
