Available live and on demand, each 30-minute session provides you with an update on recent court decisions, as well as pending and new legislative and policy developments. Members of our Indigenous Law group deliver timely and practical information about what these developments mean for your business.

For the October webinar, Richard J. King, partner and Co-Chair of Osler’s Regulatory, Indigenous and Environmental Group, along with Ankita Gupta, associate, Disputes will discuss the following topics:

  • In the last few months, the Supreme Court of Canada and Alberta Court of Appeal have both weighed in on the application of limitation periods to claims for breaches of treaty rights and other Indigenous rights. We will discuss Shot Both Sides v. Canada, 2024 SCC 12 and Wesley v. Alberta, 2024 ABCA 276 and discuss how two appellate courts have applied limitation periods to Aboriginal claims.
  • In 2010, the Supreme Court of Canada held that the duty to consult extends to “strategic, higher-level decisions” that may have an impact on Aboriginal rights and claims. We will review case law over the last decade and discuss what this phrase means and what kinds of government actions have been found to constitute strategic, higher-level decisions.
