Amicable Divorce Settlement Agreement before Courts of Dubai

Thus done and executed on Thursday corresponding to …./…./2015 in Dubai, United Arab Emirates, this agreement was signed between:-

1) xxxx - xxxxxx national holding passport No. xxxxxx

(Hereinafter called the “First Party”)

2) xxxxxxx– xxxxx  national holding passport No. xxxxxx

(Hereinafter called The “Second Party”)

Preamble

  1. Whereas, the above mentioned Parties were married on xxxxx according to a valid and duly notarized marriage contract in Dubai through the Indian Embassy, and attested in United Arab Emirates.
  2. And whereas the above mentioned Parties have the desire to divorce due to irreconcilable differences between the Parties and irretrievable breakdown of the marriage relationship with no reasonable prospects of restoring it, and to dissolve their marriage amicably.
  3. Therefore both Parties accept and agree to sign such agreement to dictate their rights arising from their marriage and divorce, and both Parties hereby agree in their legal capacities to the following:-

First

  1. The preamble is to read and be interpreted as an integral part of this agreement.

Second

Marriage and Divorce Rights

  1. The First Party divorces the Second Party before the Dubai Courts.
  2. The Second Party agrees to waive all of her marriage rights which includes but not limited to dowry, marriage alimony, any other marriage or divorce rights, and all other rights arising from their marriage or divorce except where provided for in this agreement.
  3. The Second Party shall not have the right to demand from the First Party, either at present or future, any of such rights arising from their marriage or divorce except where provided for in this agreement.
  4. The First Party agrees to waive all of his marriage rights which includes any other marriage or divorce rights, and all other rights arising from their marriage or divorce except where provided for in this agreement.
  5. The First Party shall not have the right to demand from the Second  Party, either at present or future, any of such rights arising from their marriage or divorce except were provided for in this agreement.

Third

Attestation

  1. Both Parties agreed to take necessary actions to make this agreement official through Dubai Courts and to have it considered as an executive deed.

Forth

General Provisions

  1. Both Parties agreed that this divorce is a mutual divorce and final settlement which they both accept after having taken full independent legal advice related to such settlement and its provisions from qualified advocates.
  2. Both Parties have entered in to this agreement freely with full knowledge of the financial position of the other Party.
  3. That this settlement is intended by both Parties to be final, and a clean break, and that neither Party shall be able to make any further financial claims from the other of any nature in any jurisdiction.
  4. That in the event of the death of one Party, the other Party shall not be entitled to make a claim from his or her estate.
  5. The Parties have agreed that the Second Party has launched and will bear the costs for the divorce action in the Dubai Courts.

Fifth

Copies

  1. Such agreement made in three copies; each Party retaining one copy and the third copy for official use by the Dubai Court.
