Admitido A Trámite Un Recurso De Casación Relativo Al Régimen Sancionador Sobre Operaciones Vinculadas

El Tribunal Supremo ha admitido a trámite un recurso de
casación en el que deberá pronunciarse sobre la
posibilidad de sancionar al obligado tributario por dejar de
ingresar la deuda tributaria (artículo 191 de la LGT)
cuando, no habiéndose incumplido las obligaciones de
documentación exigidas en relación a las operaciones
vinculadas, la AEAT efectúa correcciones sobre la
valoración de estas operaciones.
Resulta de gran interés ya que el Tribunal Supremo
podrá pronunciarse sobre la compatibilidad de la
sanción por dejar de ingresar del artículo 191 de la
LGT con el régimen sancionador específico aplicables
a las operaciones vinculadas.
