Effective Date Of DOL Amendments To ERISA Fiduciary Investment Regulation Set For January 12

DOL amendments to the "investment duties" regulation
(29 C.F.R. 2550.404a-1) under the Employee
Retirement Income Security Act of 1974 ("ERISA") were published in the Federal Register. The
amendments - which require fiduciaries of plans subject to ERISA to
make investment decisions based solely on risk-adjusted economic
value - go into effect on January 12, 2021.
As previously covered, the DOL final rule is
intended to provide a clear regulatory structure for ERISA Plan
fiduciaries in light of recent trends relating to environmental,
social and corporate governance investing.
