The Unified Patent Court (UPC) has been a reality since June 1, 2023. It is already shifting the boundaries in global patent litigation. Due to the availability of a pan-European injunction within a rocket-docket time frame, it does not come as a surprise that the first UPC cases – including preliminary injunctions – were already filed. At the same time, national European courts, and foreign venues (e.g., ITC) continue to play a vital role in global patent enforcement campaigns. It is fair to state that complexity is greater than ever. Thus, for both plaintiffs and defendants, it is critical to understand the interplay of UPC and national court proceedings and the strategic options it provides.
