With 3.17 billion people using the internet, it is not surprising that novel insurance issues have emerged. This paper, authored by insurance defence lawyer Laura Emmett and student-at-law Natalie Carrothers, explores the duty to defend and indemnify in instances where sexual assault and bullying allegations stem from online conduct. The paper also outlines the cost consequences and risks to the Insurer where the coverage determination is incorrect.
