After many setbacks and delays since ratification of Europe's Unified Patent Court (UPC) in 2013, the UPC appears primed to go live, perhaps by the end of 2022. And on the UPC's first day of operation, European patents can be enforced or challenged in a single venue, rather than having to bring actions in individual European jurisdictions. These will be fast-moving actions requiring careful attention, especially in the early phases of procedural development. With an operational UPC only months away, there are several actions potential parties can take now to prepare.

Topics to be discussed include:

  • Structure of the Court
  • A UPC action from beginning to end—timelines, costs, available procedures
  • Strategic considerations (unitary patents, opting in/out)
  • Preparing a UPC litigation strategy
