Spain: Las Retribuciones De Los Trabajadores De Empresas Públicas Se Corresponderán Con Las Del Puesto Efectivamente Desempeñado

Sentencia del Tribunal Supremo, Sala Cuarta de lo Social, de fecha 5 de febrero de 2019, 86/2019 (Rec. 3123/2017).

La cuestión que se suscita en el presente recurso de casación es la de determinar si un trabajador de una empresa pública que venía realizando funciones de un puesto de trabajo encuadrado en un grupo superior, tiene derecho a las diferencias retributivas, a pesar de que ese puesto de trabajo no está incluido como tal en la relación de puestos de trabajo de la mencionada empresa.

En los presentes autos, el trabajador prestaba servicios en una sociedad mercantil pública, cuyas relaciones laborales de la plantilla se regían por el convenio colectivo del servicio de aguas municipal de Burgos, si bien, de forma supletoria, era de aplicación en lo referente a las materias de clasificación profesional, el convenio colectivo estatal de industrias de  captación, elevación, conducción, tratamiento, distribución, saneamiento y depuración de aguas potables y residuales.

El trabajador ostentaba categoría de operador de control de primera, si bien, debido a que su jefe de administración ascendió a gerente del servicio, este pasó a realizar las funciones que antes realizaba aquel. Ante la presente situación, el trabajador presentó reclamación, cuyo resultado fue el reconocimiento provisional de la categoría de subjefe de grupo, así como el abono de las diferencias del año 2016. No obstante, no se aprobó nada al respecto.

Ante dicha pasividad, el trabajador interpuso demanda ante el juzgado de lo social, cuyo fallo fue la desestimación completa de sus peticiones. Posteriormente recurrió en suplicación ante la Sala de lo Social del Tribunal Superior de Justicia de Castilla y León, la cual dictó sentencia confirmatoria de la sentencia recurrida.

El fallo de la sentencia de suplicación se fundamentaba en que (i) si bien en el convenio colectivo de aplicación aparecía una categoría de subjefe de grupo, esta plaza no estaba incorporada en la plantilla orgánica de los años 2016 y 2017; (ii) la Relación de Puestos de Trabajo debía ser aprobada por el Ayuntamiento de Burgos, por lo que al tratarse de una empresa pública, la plaza no estaba dotada presupuestariamente, instando al trabajador a interesar ante la jurisdicción correspondiente la aprobación de la plantilla en la que se incluyera la retribución que reclama.

La Sala de lo Social del Tribunal Supremo estimó el recurso interpuesto. Fundamenta la Sala su fallo, en las siguientes tres razones:

(i) La primera, la literalidad del artículo 39.3 del Estatuto de los Trabajadores, según el cual el trabajador tendrá derecho a la retribución correspondiente a las funciones que efectivamente realice, siempre y cuando, dichas funciones excedan de manera notoria a las asignadas a su categoría, y quede suficientemente probado que se estas desarrollando por completo y no parcialmente.

(ii) La segunda razón, porque es obligación de la empresa la adecuación de la plantilla a la situación real que se produzca. No resultando de recibo que la desidia de la entidad demandada que no efectúa tal adecuación que solo a ella le corresponde se torne en un impedimento para la aplicación del artículo 39.3 del Estatuto de los Trabajadores, obligando al trabajador a efectuar dos reclamaciones distintas, una para que se modifique la plantilla y otra para reclamar las diferencias salariales.

(iii) Por último, la tercera razón es que no se pude imponer al trabajador la obligación de reclamar la creación del puesto pues, además de ser una imposición no establecida legalmente, conduciría a la instauración de un auténtico fraude.
