COMUNICADO DO CONSELHO DE MINISTROS DE 20 DE SETEMBRO DE 2018

Foi aprovado, entre outros, o seguinte:

1. O Conselho de Ministros aprovou cinco diplomas no âmbito da reforma da justiça administrativa e fiscal, visando a modernização e racionalização do sistema:

  • Foi aprovada a proposta de lei que altera o Estatuto dos Tribunais Administrativos e Fiscais. Numa lógica de agilização dos procedimentos e incremento da eficiência e celeridade do sistema, a intervenção proposta assenta em três traves-mestras: a especialização dos tribunais de primeira instância; a consagração de um novo modelo de gestão dos tribunais administrativos e fiscais; e a revisão do modelo dos gabinetes de apoio aos tribunais;
  • Foi igualmente aprovada uma proposta de lei que altera os regimes processuais no âmbito da jurisdição administrativa e fiscal. Prevê-se a tramitação eletrónica obrigatória do processo judicial na jurisdição administrativa e fiscal e várias outras medidas de simplificação e agregação processual, principalmente ao nível do processo tributário;
  • Foram criadas, por decreto-lei, as equipas de magistrados judiciais que têm por missão proceder à recuperação de pendências nos tribunais administrativos e tributários, procurando, num curto espaço de tempo, melhorar a qualidade da resposta do sistema; com o mesmo objetivo, este diploma institui ainda incentivos para a desistência de processos, a revisão de atos tributários e o recurso à arbitragem;
  • Aprovou-se o decreto-lei que altera o Regulamento das Custas Processuais;
  • Foi aprovada a proposta de lei que consagra a aplicação do processo de execução fiscal à cobrança coerciva das custas, multas, coimas e outras quantias cobradas em processo judicial.

2. O Conselho de Ministros aprovou um conjunto de quatro diplomas que vêm complementar o pacote de medidas apresentado na semana passada no âmbito do processo de transferência de competências para as autarquias locais e para as entidades intermunicipais previsto na Lei-Quadro da Descentralização, publicada a 16 de agosto.

3. O Governo apresenta à Assembleia da República as propostas de resolução que aprovam o Terceiro e o Quarto Protocolos Adicionais à Convenção Europeia de Extradição.
