A. Einleitung
Colgate-Palmolive Europe Sàrl (ehemals Gaba International AG) («Colgate- Palmolive») hatte mit Gebro Pharma GmbH («Gebro») (Österreich) 1982 einen Lizenzvertrag zur Herstellung und zum Vertrieb von Elmex-Produkten abgeschlossen. Der Lizenzvertrag untersagte Gebro, Elmex ausserhalb Österreichs zu verkaufen. Die Wettbewerbskommission kam zum Schluss, dass dieser Vertrag unter Art. 5 Abs. 4 KG falle, der Vertrag eine erhebliche Wettbewerbsbeeinträchtigung darstelle, die nicht durch Gründe wirtschaftlicher Effizienz gerechtfertigt werden könne, und deshalb unzulässig sei. Die Beschwerden von Colgate-Palmolive und Gebro gegen diese Verfügung wurden sowohl vom Bundesverwaltungsgericht als auch vom Bundesgericht' abgewiesen.
