General Court confirms prohibition of Deutsche Börse/NYSE Euronext merger

The General Court has upheld the European Commission's decision prohibiting the proposed merger between Deutsche Börse and NYSE Euronext, rejecting all the pleas put forward by Deutsche Börse. 

In particular, the General Court considered that there was no basis for calling into question the Commission's conclusions on the definition of the relevant market, the efficiency gains associated with the merger or the commitments offered by the companies. Click here.

CMA issues preliminary invitation to comment in relation to the BT/EE merger

The CMA has issued a preliminary invitation to comment in relation to the anticipated acquisition by BT of EE, which is an early opportunity for interested third parties to make their views known on the transaction.

  • The European Court of Justice has dismissed appeals by Versalis, Eni and the European Commission against the General Court's judgment in relation to the chloroprene rubber cartel case.  In particular, the ECJ held that the General Court had been right to uphold the Commission's finding that Eni and Versalis were liable for the infringements of their subsidiary companies. Click here
