The Regulation on Electricity Facilities Project (the "Regulation") published in the Official Gazette on December 30, 2014 and numbered 29221 (Mükerrer), has gone into effect on the date of its publication in the Official Gazette. The Regulation abolishes the Regulation on Electricity Facilities Project published in the Official Gazette on December 16, 2009 and numbered 27434. The purpose of the Regulation is to determine the procedures and principles regarding (i) the incorporation and the project approval process of the electricity facilities to ensure compliance with modern technology; (ii) the connection of the facilities to the transmission and distribution networks; (iii) the safety and protection of life, property and environment; and (iv) authorization for institutions/establishments or legal entities in charge of granting project approvals.

Requirements regarding the incorporation of electricity facilities and procedures regarding the acceptance process are carried out under this Regulation and the Electricity Facilities Acceptance Regulation¹.

The production facilities, such as hydroelectric power plants ("HEPP"), wind power plants, geothermal energy plants and the other types of facilities, such as emergency groups, lighting projects and underground cables come within the scope of this Regulation. Pursuant to Article 16 of the Regulation, the project approval and acceptance processes regarding specific components of HEPPs (storage facilities, water transmission pipelines, forebay pools and surge shaft, waste channels, water stilling basin and tailwater facilities of the HEPP) will be regulated under a separate secondary legislation to be adopted by the State Hydraulic Works within 6 (six) months from the publication of this Regulation.

In accordance with the Electricity Facilities Acceptance Regulation published in the Official Gazette dated May 7, 1995 and numbered 22280, provisional acceptance of an electricity facility is only possible if it has been determined by the minutes that the facility has been built in compliance with the approved project, applicable legislation, articles of association and the facility agreement executed with the institution supplying energy. Final acceptance is to be granted at least 1 (one) year after  provisional acceptance.
