Arbitrating Investment Disputes in Africa: The Nigerian and Ghanaian Framework

Ugonna Ogbuagu is a Senior Associate in the firm’s Dispute Resolution, Corporate/Commercial, Labour and Infrastructure Practice Groups. He has significant dispute resolution experience, and has advised and represented a broad range of clients in disputes arising from oil and gas projects, commercial transactions, infrastructure projects, labour and employment issues and tax disputes. He has extensive knowledge and experience in commercial dispute resolution mechanisms, and represents clients in mediation, arbitration and litigation proceedings. Also, he routinely provides transaction support to various clients on mergers and acquisitions and other commercial transactions. In addition, he routinely advises clients on infrastructure projects.

Perenami is a Partner in the firm’s Dispute Resolution, Insolvency, Energy, and Labour Practice Groups. She is regularly involved in high stakes, commercial disputes resolution before arbitral tribunals and superior courts. She is currently leading the team handling a portfolio of matters arising out of the privatisation & bid process, ownership and title of one of Nigeria’s major enterprises. She led a team that successfully represented an exploration and production company in an arbitration pertaining to assignment of interest and cost recovery in a marginal field to the tune of about US$40 million.

Kwesi Dadzie-Yorke is an Associate with the firm's office in Accra, Ghana. Kwesi practices with the firm's Dispute Resolution, Corporate/Commercial, Intellectual Property and International Trade Practice Groups. He is an experienced banker and has extensive knowledge and experience in litigation, mediation and arbitration. He provides advice to clients on company secretarial services, trademarks, commercial transactions, mergers and international trade.

Funke Adekoya is a Senior Advocate of Nigeria and partner and head of the arbitration practice at AELEX. She is a Chartered Arbitrator of the Chartered Institute of Arbitrators and is ranked in Chambers Global and in Who’s Who Legal Arbitration, is listed on the Chairman’s Panel of Arbitrators at ICSID and is currently a member of the ICC Africa Commission. She has received both party and institutional appointments as arbitrator in investment disputes under the ICC and ICSID rules arising out of the energy, natural resources and infrastructure construction sectors in Africa and other emerging markets.
