Pryor Cashman client Penthouse Global Media, Inc. has been awarded more than $540,000 in damages in a licensing and trademark dispute with The Executive Club LLC.

The two parties entered into a licensing agreement under which Penthouse granted The Executive Club the right to use its name and trademark in connection with an adult club located on the West Side of Manhattan. When The Executive Club stopped paying for the license, Penthouse brought suit. 

In a decision issued this week, Justice Nancy Bannon of the New York State Supreme Court granted summary judgment on Penthouse's claims for - among other things - breach of contract and trademark infringement, after The Executive Club continued to use the Penthouse name on its website even after the license was terminated.

A hearing will be held to determine the amount of interest and legal fees The Executive Club will be ordered to pay to Penthouse.
