The SEC clarified that any registrant may voluntarily comply with the recently adopted mining disclosure requirements by satisfying (i) Regulation S-K Subpart 229.1300 ("Disclosure by Registrants Engaged in Mining Operations") requirements and (ii) EDGAR requirements. Although EDGAR reprogramming changes are ongoing, the SEC stated, these changes should not prevent registrants from early compliance with the mining requirements.

As previously covered, all registrants active in mining operations must comply with the final rule amendments beginning on January 1, 2021.
