According to a federal court, employers subject to EEO-1 reporting requirements must submit the detailed pay data required by Component 2 no later than September 30, 2019. The data to be produced includes compensation and hours worked, broken down by job category, pay band, race, ethnicity and gender.

The employment data categorized by race/ethnicity, gender and job category (Component 1) must be submitted by May 31, 2019.

So until further notice, the current action items for employers are:

  • Prepare the Component 1 portion of the EEO-1 and submit it by May 31, 2019;
  • Prepare the Component 2 portion of the EEO-1 with 2018 data and submit it by September 30, 2019; and
  • Stay tuned for more information regarding whether 2017 or 2019 data must also be produced.
