The SEC amended its rules to delegate authority to the General Counsel with respect to certain routine matters in administrative proceedings. The final rule will become effective on the date of its publication in the Federal Register.

The amendment authorizes the General Counsel to make determinations concerning "procedural requests and other non-dispositive, pre-hearing matters" in administrative proceedings. The General Counsel would be able to, among other things:

  • modify or cancel hearing dates;
  • deny or permit leave to file motions and other papers;
  • order parties to meet for prehearing conferences; and
  • strike procedurally deficient filings.
