Summary
Contemporary international arbitration is at the same time a legal
field, a sector of the economy and a social field with its actors
and rituals. This article analyzes the contribution made to
international arbitration by the French Legal school of thought. It
highlights the rules of arbitration law that were exported over the
years (severability of the arbitration agreement,
competence-competence, negative effect of competence-competence,
etc.), while the international practice imported techniques
inspired by the common law tradition (document production,
cross-examination of witnesses, etc.). International arbitration
also generates law. For practitioners, arbitral case law is a daily
reality and, when looking at the matter in an abstract way, one may
conclude that there exists a true autonomous arbitral legal order
which interacts with State legal orders.
Résumé
L'arbitrage international contemporain est à la fois une
discipline juridique, un secteur à part entière de
l'économie des services et un champ social dont il est
possible d'identifier les acteurs et les rites. Le
présent article a pour objet d'analyser l'apport de
la pensée juridique française à la
matière. Il rappelle les règles du droit savant de
l'arbitrage qu'au fil des années le droit
français a exporté (autonomie de la convention
d'arbitrage, compétence-compétence, effet
négatif de la compétence-compétence... ),
tandis que la pratique internationale importait des techniques
inspirées de la tradition de common law (production de
documents, contre-interrogatoire des témoins...).
L'arbitrage international est également un mode de
production du droit. La jurisprudence arbitrale est une
réalité quotidienne pour tous ceux qui pratiquent la
matière, ce qui permet à ceux qui s'autorisent
à l'appréhender de manière très
abstraite, ce qui est une marque de la pensée juridique
française, de conclure à l'émergence
d'un véritable ordre juridique arbitral en dialogue
constant avec les ordres juridiques étatiques.
