A U.S. State contract to build a $160-million embassy compound in Mozambique may provide losing bidders with another opportunity to seal the deal after a U.S. Court of Federal Claims ruling that there may have been improper contact by agency procurement staff.
The decision followed a challenge from Alabama-based Caddell Construction, who was also in the running for the contract, after they chose to file last year.
Fox Rothschild's Alexa Santora, who represents Caddell in the case, says the company has not been notified when the State Dept. will make its new award decision. "From what we understand, Caddell, Pernix and B.L. Harbert remain in consideration," she says.
Santora says it is unclear whether the court's order that the agency re-open discussions and accept revised pricing from only one bidder will change the outcome of the award process. "That is yet to be seen," she says.
