A grievance has been filed by nearly 250 Texas lawyers against Attorney General Ken Paxton for his public comments made after the U.S. Supreme court's gay marriage ruling which may have "improperly encouraged county clerks to break the law" by discriminating on the basis of sexual orientation.

Accompanying Paxton's ethics investigation, he is also facing felony securities fraud charges and a criminal investigation from a land deal that occurred prior to his election.

Fox Rothschild's Ernie Badway said it looks "pretty awful" to the public to have the state's chief law enforcement officer under indictment and having his conduct be questioned.

"I personally have been repelled by many Supreme Court decisions that have been issued in my lifetime, but that doesn't mean I'm going to flout the law and ignore a Supreme Court decision," Badway said. "Just because you find it repugnant doesn't mean you can ignore it."
